Purchase Conditions

This document contains the rules governing the purchase of our products and the agreement we establish with you. The parties bound by these terms and conditions are: DIMONI GROUP BRANDS, S.L.U. with tax identification number B24846941, domiciled at Ronda del Parque Nº 1 - B, 03640, Monóvar (Alicante), Spain, and the user who completes the registration in the corresponding form, hereinafter, USER.

Please read carefully the following rules that regulate the services we offer at MISS ELASTIC. These conditions must be accepted in advance to purchase MISS ELASTIC products.

The website www.misselastic.com has been created by MISS ELASTIC for informational and personal use. By accessing this website, you accept the following terms and conditions. Accessing and browsing this website implies the acceptance and knowledge of the legal warnings, conditions and terms of use contained therein.

Registration

Individuals of legal age, with sufficient capacity to contract, who have correctly registered by filling out the registration form in the corresponding section, may access our services and purchase our products. The data entered in the form must be complete and truthful. MISS ELASTIC reserves the right to refuse or deregister those who fail to comply with this requirement. The safeguarding of the username and password is the exclusive responsibility of the USER.

Service Availability

To place an order, you must follow the online purchase procedure detailed on the website. After this, within 24 hours, and always before the time of delivery, you will receive an email acknowledging receipt of your order (the "Order Confirmation").

Product Availability

All product orders are subject to product availability. If items are out of stock, we commit to informing you immediately and providing you with information about similar products of the same or higher quality that you may order. If you do not wish to order these substitute products, we will refund any amount you may have paid immediately (always within 14 days of your communication). In case of unjustified delay in the return of the amounts, you will be entitled to a refund of double the amount paid.

Shopping at MISS ELASTIC

Duly registered users can shop online at MISS ELASTIC's website, www.misselastic.com, through the established means and forms 24 hours a day, 7 days a week. The prices displayed are final in Euros (€) and include taxes, unless otherwise specified and applied by legal requirement, especially regarding VAT. Registration and acceptance of these conditions imply conformity with the product, its characteristics and price. Likewise, every order requires the acceptance of quantities, prices, descriptions, shipping method and payment method of the products available for sale requested by the USER.

Payments

The payment methods accepted at MISS ELASTIC will be credit or debit card, and PayPal. It is not permitted to use third-party payment data or instruments.

Transaction Security

MISS ELASTIC uses all means to guarantee the confidentiality and security of the data transmitted through the web and on the website www.misselastic.com. As such, the website uses a secure SSL (Secure Socket Layer) payment system.

Shipping

The preparation of the parcel in our warehouses will take place on the same day we receive payment confirmation in our system, provided that this confirmation occurs before 10:00 a.m. (Spanish Peninsular Time), Monday to Friday. Otherwise, preparation will be carried out on the next business day after payment confirmation, where possible.

All shipments are the responsibility of MISS ELASTIC. Delivery will be made to the address indicated by the USER for this purpose, through the courier service that MISS ELASTIC deems most appropriate. It will be the USER's responsibility to ensure, at the time of delivery, that the shipment is in good condition.

(Delivery times are calculated in business days: Monday to Friday, excluding public holidays).

Shipping within Spain: Free on purchases equal to or above €59 (mainland and Balearic Islands).

Shipping in Europe and internationally: Standard shipping is free on purchases equal to or above €99, except in the countries marked with a fixed surcharge.

* Customs Notice: For shipments to the Canary Islands, Ceuta, Melilla, or non-EU countries (United Kingdom, Switzerland, Norway, Andorra, USA, Canada, Japan, etc.), local taxes, customs duties or customs management fees are not included in the price and will be borne by the customer at the time of delivery.

Delivery times are estimates. During special promotions, sales or holiday periods, preparation and shipping may experience slight delays due to high logistics volume.

How to process your return?

At Miss Elastic, we want you to enjoy your footwear with complete peace of mind. If for any reason you need to change a size or make a return, we make it very easy for you.

The USER has a legal period of 14 days from the date of receipt of the products to exercise their right of withdrawal. MISS ELASTIC extends this period by granting 30 calendar days from the dispatch of the product for withdrawals, exchanges and/or returns. The conditions for exercising this right are those mentioned in the following paragraph.

Return conditions: For the exchange or return to be accepted, the items must be returned in their original packaging, unused and in perfect condition. The cost associated with the return (indicated in the table above according to each country, applied per returned item) will be deducted from the final refund.

To do so, you must log in to your personal account, select the order you wish to return and follow the procedure provided to request the return.

Once the request is registered, you will receive instructions on the next steps, including shipping the product, if necessary.

Acceptance of the return will be subject to compliance with the conditions established in this policy.

MISS ELASTIC's Responsibility

MISS ELASTIC is not responsible if the chosen product is not as displayed on the website due to technical problems or other such issues. MISS ELASTIC will act with the utmost diligence to make the selected product available to the transport company.

Reservation of Rights

MISS ELASTIC reserves the right not to admit the registration of certain USERS, as well as the right to modify the prices of its products. MISS ELASTIC reserves the right to verify the personal information provided by the USER and take the measures it deems necessary to verify it.

Jurisdiction and Applicable Law

The terms and conditions governing this page and all relationships that may arise are safeguarded by Spanish law. Any controversy that may arise from accessing or using this page is subject to the exclusive jurisdiction of the courts of Alicante.
